Design Den - Terms & Conditions.

1. Introduction

1.1. These Terms & Conditions (“T&Cs”) apply exclusively to services provided by Design Den, a division of FYE Design, which operates under Run-E-Way Australia Pty Ltd (ACN 656 749 432).


1.2. By engaging Design Den’s services, purchasing a time-based design package, or submitting a design request, you (“Client”) agree to be bound by these T&Cs.


1.3. These T&Cs are separate from FYE Design’s Terms & Conditions, which govern project-based branding and identity design services.

2. Service Model & Time-Based Billing

2.1. Prepaid Design Packages:

- Design Den offers time-based design packages of 2, 5, and 10 hours, which clients purchase in advance.

- Purchased hours can be used flexibly within the stated validity period for any design tasks covered under these T&Cs.

2.2. No Order Cap & Unlimited Revisions:

- Clients may submit as many design requests as they need within their purchased time.

- Revisions are unlimited as long as they are within the purchased time allocation.

- Each task is tracked by time spent, including briefing, design execution, revisions, and final file preparation.

2.3. Time Tracking & Usage Reporting:

- Design time is logged in 15-minute increments and deducted from the available balance.

- Clients may request a usage report at any time.

- A summary of remaining hours will be provided at the end of each month or upon request.

2.4. Time Expiry & Rollovers:

- 2-hour packages expire after 1 month.

- 5-hour packages expire after 2 months.

- 10-hour packages expire after 3 months.

- Unused time does not roll over past the validity period unless otherwise agreed upon.

3. Scope of Services

3.1. Design Den provides print-focused graphic design services, including but not limited to:

- Business cards, flyers, brochures, posters, and banners

- Signage, large-format graphics, and marketing materials

- Print-ready file setup and prepress formatting

3.2. What’s Not Included:

- Brand Strategy, Custom Logo & Identity Design (Covered under FYE Design)

- Website Design or Development

- Motion Graphics or Video Editing

​

4. Turnaround Times & Delivery

4.1. Standard Turnaround:

- Most design tasks are completed within 24-48 hours, depending on complexity and current workload.

- Larger or multi-page documents may take longer, and estimated delivery times will be communicated.

4.2. Priority & Urgent Requests:

- Design Den prioritises tasks based on the client’s purchased package and workload schedule.

- Clients needing urgent work (same-day or overnight turnaround) should notify Design Den ASAP, and time permitting, we will accommodate the request.

4.3. File Formats & Delivery:

- Final files will be provided in PDF, PNG, JPG, or AI format, as per client needs.

- Print-ready files include correct colour profiles (CMYK), bleed, and crop marks.

- Source files may be available upon request, subject to additional fees.

5. Payments & Refunds

5.1. Payment Terms:

- All design time must be prepaid before work commences.

- Payments can be made via bank transfer, credit card, or online payment gateway.

5.2. Refund Policy:

- Due to the nature of prepaid time-based services, refunds are not provided once a package is purchased.

- Exceptions: If Design Den is unable to fulfill the agreed-upon design services within a reasonable timeframe, a partial refund may be considered at our discretion.

5.3. Unused Hours & Expiry:

- Clients are responsible for tracking their time usage and submitting requests before their package expires.

- No refunds or credits will be issued for unused time after expiry.

6. Confidentiality & Data Protection

6.1. Client Confidentiality:

- Design Den works directly with print businesses only and does not communicate with their clients.

- All design files and business information remain confidential and are not shared with third parties.

​

6.2. No Overseas Outsourcing:

- All work is completed in-house in Australia—we do not outsource overseas.

- This ensures consistent quality, faster response times, and confidentiality.

​

7. Revisions, Errors & Liability

7.1. Client Responsibility for Final Approval:

- Clients are responsible for reviewing all proofs and final files before printing.

- Design Den is not liable for printing errors if the file was approved by the client.

​

7.2. Corrections & Minor Adjustments:

- If an error was made by Design Den, it will be corrected at no additional cost.

- If the client requests changes after final approval, additional time will be deducted from their balance.

​

7.3. Liability Disclaimer:

- While Design Den strives for accuracy, we are not liable for losses due to printing errors, production issues, or third-party actions beyond our control.

​

8. Modifications & Termination of Service

8.1. Policy Updates:

- Design Den may update these T&Cs at any time. Clients will be notified of major changes via email or website updates.

​

8.2. Service Termination:

- Design Den reserves the right to terminate services if a client engages in unreasonable demands, excessive revisions beyond their time allocation, or inappropriate conduct.
